GRAIN Hizmet Koşulları

1. Kabul ve kapsam

Bu koşullar, Useroam Teknoloji Limited Şirketi ("biz") tarafından sunulan GRAIN oyununun (App Store'da "GRAIN: Sand Puzzle"; iOS, Android ve web sürümleri) kullanımını düzenler. Oyunu indirerek veya oynayarak bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız oyunu kullanmayın. Kişisel verilerinizin nasıl işlendiği Gizlilik Politikası ve KVKK Aydınlatma Metni'nde anlatılır.

2. Yaş

Oyun 13 yaş ve üzerine yöneliktir. 18 yaşından küçükseniz oyunu, özellikle uygulama içi satın almaları, ancak ebeveyninizin veya vasinizin izniyle kullanabilirsiniz. Mağaza hesabınızdaki ebeveyn denetimleri satın almaları sınırlandırabilir.

3. Hesap ve takma ad

Oyun e-posta veya şifre istemez; ilk açılışta cihazınıza rastgele bir jeton atanır ve seçtiğiniz takma ad, bayrak ve avatar bu jetona bağlanır. Takma adınız ve skorlarınız liderlik tablolarında diğer oyunculara açıktır; gerçek adınızı kullanmamanızı öneririz.

Takma adınız; küfür, aşağılama, ayrımcılık, cinsel içerik, başka bir kişiyi, markayı veya bizi taklit eden ya da hukuka aykırı ifadeler içeremez. Bu kurala uymayan takma adları önceden bildirimde bulunmadan değiştirebilir veya silebilir, tekrarında hesabı liderlik tablolarından çıkarabiliriz. Takma adlar büyük/küçük harf farkı gözetilmeksizin benzersizdir; başka bir oyuncunun kullandığı ad alınamaz. Ad seçmezseniz size rastgele bir ad (ör. Gezgin4821) verilir. Takma adınızı kayıttan sonra yalnızca bir kez değiştirebilirsiniz; bayrak ve avatar sınırsız değiştirilebilir.

Jeton cihazınızda saklanır. Uygulamayı silmek veya cihaz verisini temizlemek hesabınıza erişimi kaybettirebilir; e-posta kaydı olmadığı için bu durumda hesabı size geri veremeyebiliriz.

4. Uygulama içi satın almalar ve sanal altın

• Mobil uygulamada tüketilebilir altın paketleri (100, 350 ve 1200 altın) ve tek seferlik "Reklamsız" ürünü satılır. Satış App Store veya Google Play üzerinden yapılır; ödemeyi mağaza alır, satın almayı RevenueCat hizmetiyle doğrularız.
• Altın ve oyun içi güçler size yalnızca oyun içinde kullanılmak üzere kişisel, devredilemez, geri alınabilir sınırlı bir kullanım lisansı verir; mülkiyet sağlamaz. Altının nakit değeri yoktur, paraya çevrilemez, başka bir oyuncuya veya hesaba aktarılamaz, satılamaz.
• Satın alınan altın cihazınızda saklanır. Apple veya Google ile giriş yaptıysanız kaydınız hesabınızda da tutulur; uygulamayı silseniz bile tekrar giriş yapınca harcanmamış altınınız geri gelir. Giriş yapmadıysanız kayıt yalnız cihazdadır: uygulamayı silmek veya cihaz verisini temizlemek harcanmamış altını siler. Bu yüzden altın satın almadan önce giriş yapmanızı öneririz.
• "Reklamsız" ürünü zorunlu (geçiş) reklamları kaldırır; isteğe bağlı ödüllü videolar kalır. Aynı mağaza hesabıyla Dükkân › "Satın alımları geri yükle" düğmesinden geri yüklenebilir.
• İadeler ilgili mağazanın iade politikasına göre mağaza üzerinden talep edilir; biz doğrudan iade yapamayız. Satın alma işlemi ve ödeme akışı ilgili mağaza (Apple App Store veya Google Play) tarafından yürütülür; cayma hakkına ilişkin bilgilendirme ve onay da o akışın parçasıdır. Anında ifa edilen dijital içerikte, 6502 sayılı Kanun ve Mesafeli Sözleşmeler Yönetmeliği'nin öngördüğü hâllerde cayma hakkı kullanılamayabilir. Kanunun size tanıdığı ayıplı hizmet ve diğer zorunlu haklar saklıdır.
• Fiyatlar mağazada gösterilir ve vergiler dahil olarak mağaza tarafından tahsil edilir.

5. Reklamlar

Oyun ücretsizdir ve Google AdMob reklamlarıyla desteklenir: izlemeyi seçtiğiniz ödüllü videolar ve seyrek geçiş reklamları. Reklam izni tercihlerinizi Ayarlar › Reklam izni tercihleri (izin istenen bölgelerde) veya cihazınızın gizlilik ayarlarından değiştirebilirsiniz. Reklamların içeriğinden reklamveren sorumludur; reklamlardaki bağlantılar üçüncü taraf hizmetlere götürür.

6. Yasaklı davranışlar

Aşağıdakiler yasaktır:

• Hile yapmak; skor, altın, süre veya kayıt verisini değiştirmek ya da sahte skor göndermek
• Uygulamayı değiştirmek, kaynak kodunu çözmek (kanunun izin verdiği hâller hariç), hile yazılımı veya değiştirilmiş sürüm kullanmak
• Bot, betik veya başka otomatik yollarla oynamak ya da sunucumuza istek göndermek
• Oyundaki hataları bilerek kendi lehine kullanmak (hata bulursanız bize bildirmeniz rica olunur)
• Sunucuya aşırı yük bindirmek, hizmeti aksatmak veya başka oyuncuların hesaplarına erişmeye çalışmak

Bu davranışları tespit edersek ilgili skorları ve rozetleri silebilir, hesabı liderlik tablolarından çıkarabilir veya hizmete erişimi kısıtlayabiliriz.

7. Fikri mülkiyet

GRAIN adı, logosu, oyun tasarımı, bölümler, görseller, sesler ve yazılım Useroam Teknoloji'ye veya lisans verenlerine aittir ve 5846 sayılı Fikir ve Sanat Eserleri Kanunu ile ilgili mevzuat kapsamında korunur. Size yalnızca oyunu kişisel ve ticari olmayan amaçla oynamak için sınırlı, devredilemez bir kullanım hakkı verilir. Oyun ekranlarının kişisel paylaşımı serbesttir.

8. Hizmetin değişmesi ve sonlandırılması

Oyunu, bölümleri, ekonomi dengesini ve özellikleri güncelleyebilir; liderlik tabloları veya sunucu gibi çevrimiçi özellikleri makul bir süre önceden oyun içinde veya bu sayfada duyurarak durdurabiliriz. Oyun sunucu olmadan da oynanabilir. Hizmetin tamamen sonlandırılması hâlinde, harcanmamış ücretli içerik için kanunun gerektirdiği haklarınız saklıdır.

9. Sorumluluğun sınırlandırılması

Oyunu kesintisiz ve hatasız sunmak için makul özeni gösteririz; ancak internet bağlantısı, cihaz uyumluluğu, mağaza veya üçüncü taraf hizmetlerindeki (Apple, Google, RevenueCat) aksaklıklardan kaynaklanan kesintilerden, kanunun izin verdiği ölçüde sorumlu değiliz. Bu sınırlama; kastımız veya ağır ihmalimizden doğan zararlar (6098 sayılı Türk Borçlar Kanunu md. 115), 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ilgili mevzuatın sınırlanmasını veya kaldırılmasını yasakladığı sorumluluklar ve tüketici olarak sahip olduğunuz zorunlu haklar bakımından uygulanmaz.

10. Hesap silme

Hesabınızı ve sunucudaki verilerinizi (takma ad, bayrak, avatar, skorlar, rozetler, oturum kayıtları, senkronlanan oyun kaydı) uygulamada Ayarlar › Hesabı ve verileri sil ile istediğiniz zaman anında silebilirsiniz; uygulama sıfırlanır ve işlem geri alınamaz. Harcanmamış altın silinir; "Reklamsız" aynı mağaza hesabıyla geri yüklenebilir. Bu koşulları kullanmayı bırakarak da sona erdirebilirsiniz.

11. Uygulanacak hukuk ve yetkili mahkeme

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Uyuşmazlıklarda İstanbul Anadolu mahkemeleri ve icra daireleri yetkilidir (şirket merkezi Çekmeköy/İstanbul). Tüketici iseniz, her yıl belirlenen parasal sınırlar dahilinde yerleşim yerinizdeki veya işlemin yapıldığı yerdeki Tüketici Hakem Heyetlerine, bu sınırların üzerinde Tüketici Mahkemelerine başvurma hakkınız saklıdır.

12. App Store kullanıcıları

Oyunu App Store'dan indirdiyseniz Apple'ın Standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (EULA) de geçerlidir. Bu koşullar ile Apple EULA arasında çelişki olursa, App Store'dan edinilen uygulama bakımından Apple EULA'daki asgari şartlar esas alınır. Apple bu koşulların tarafı değildir ve oyunla ilgili bakım, destek veya taleplerden sorumlu değildir.

14. Değişiklikler

Bu koşulları değiştirebiliriz. Güncel hâli bu sayfada yayımlanır ve tarih güncellenir; haklarınızı esaslı biçimde etkileyen değişiklikleri yürürlükten önce oyun içinde duyururuz. Değişiklikten sonra oyunu kullanmaya devam etmeniz güncel koşulları kabul ettiğiniz anlamına gelir.

GRAIN Terms of Service

1. Acceptance and scope

These terms govern your use of GRAIN (listed on the App Store as "GRAIN: Sand Puzzle"; iOS, Android and web versions), provided by Useroam Teknoloji Limited Şirketi ("we"). By downloading or playing the game you accept these terms. If you do not accept them, do not use the game. How we process your personal data is described in the Privacy Policy and the KVKK Privacy Notice. The Turkish version prevails in case of conflict.

2. Age

The game is intended for ages 13 and up. If you are under 18, you may use the game, and in particular in-app purchases, only with the permission of your parent or guardian. Parental controls on your store account can restrict purchases.

3. Account and nickname

The game asks for no e-mail or password; on first launch a random token is assigned to your device, and the nickname, flag and avatar you choose are linked to it. Your nickname and scores are visible to other players on leaderboards; we recommend not using your real name.

Your nickname must not contain profanity, insults, discrimination, sexual content, impersonation of another person, a brand or us, or unlawful expressions. We may change or delete nicknames that break this rule without prior notice and, for repeat cases, remove the account from leaderboards. Nicknames are unique regardless of letter case; a name already used by another player cannot be taken. If you do not choose a name, a random one (e.g. Wanderer4821) is assigned. You can change your nickname only once after registering; flag and avatar can be changed freely.

The token is stored on your device. Uninstalling the app or clearing its data may cause you to lose access to your account; since no e-mail is registered, we may be unable to restore it.

4. In-app purchases and virtual gold

• The mobile app sells consumable gold packs (100, 350 and 1200 gold) and a one-time "No Ads" product. Sales are made through the App Store or Google Play; the store takes the payment and we validate purchases with RevenueCat.
• Gold and in-game power-ups grant you a personal, non-transferable, revocable, limited license to use them within the game only; they do not confer ownership. Gold has no cash value and cannot be exchanged for money, transferred to another player or account, or sold.
• Purchased gold is stored on your device. If you sign in with Apple or Google, your save is also kept with your account, so unspent gold comes back when you sign in again, even after uninstalling. If you do not sign in, the save exists only on the device: uninstalling the app or clearing its data erases unspent gold. We therefore recommend signing in before buying gold.
• "No Ads" removes mandatory (interstitial) ads; optional rewarded videos remain. It can be restored with the same store account via Shop › "Restore purchases".
• Refunds are requested from the relevant store under its refund policy; we cannot issue refunds directly. The purchase and payment flow is operated by the relevant store (Apple App Store or Google Play), and the withdrawal-right disclosure and consent are part of that flow. For digital content delivered immediately, the right of withdrawal may not apply where Turkish Law No. 6502 and the Distance Contracts Regulation so provide. Your mandatory statutory rights, including for defective services, remain unaffected.
• Prices are shown in the store and charged by the store including taxes.

5. Ads

The game is free and supported by Google AdMob ads: rewarded videos you choose to watch and occasional interstitial ads. You can change your ad consent via Settings › Ad consent preferences (in regions where consent is requested) or in your device's privacy settings. Advertisers are responsible for ad content; links in ads lead to third-party services.

6. Prohibited conduct

The following is prohibited:

• Cheating; modifying score, gold, time or save data, or submitting fake scores
• Modifying or decompiling the app (except where permitted by law), or using cheat software or modified builds
• Playing, or sending requests to our server, by bots, scripts or other automated means
• Knowingly exploiting bugs to your advantage (please report bugs to us)
• Overloading the server, disrupting the service or trying to access other players' accounts

If we detect such conduct we may delete the related scores and badges, remove the account from leaderboards or restrict access to the service.

7. Intellectual property

The GRAIN name, logo, game design, levels, artwork, sounds and software belong to Useroam Teknoloji or its licensors and are protected under Turkish Law No. 5846 on Intellectual and Artistic Works and related laws. You receive only a limited, non-transferable right to play the game for personal, non-commercial purposes. Personal sharing of game screenshots is permitted.

8. Changes to and termination of the service

We may update the game, levels, economy balance and features, and may discontinue online features such as leaderboards or the server after announcing it a reasonable time in advance in the game or on this page. The game can also be played without the server. If the service is discontinued entirely, your statutory rights regarding unspent paid content remain unaffected.

9. Limitation of liability

We take reasonable care to provide the game without interruptions or errors; however, to the extent permitted by law, we are not liable for interruptions caused by internet connectivity, device compatibility, or outages of stores or third-party services (Apple, Google, RevenueCat). This limitation does not apply to damage caused by our intent or gross negligence (Turkish Code of Obligations No. 6098, Art. 115), to liability that Law No. 6502 on Consumer Protection and related laws prohibit limiting or excluding, or to your mandatory rights as a consumer.

10. Account deletion

You can instantly delete your account and your data on our server (nickname, flag, avatar, scores, badges, session records, synced save) at any time in the app via Settings › Delete account and data; the app is reset and this cannot be undone. Unspent gold is erased; "No Ads" can be restored with the same store account. You may also end these terms by stopping use of the game.

11. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul Anadolu have jurisdiction over disputes (our registered seat is Cekmekoy/Istanbul). If you are a consumer, your right to apply to the Consumer Arbitration Committees at your place of residence or where the transaction took place, within the monetary limits set each year, or to the Consumer Courts above those limits, remains reserved.

12. App Store users

If you downloaded the game from the App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies. If these terms conflict with the Apple EULA, the minimum terms of the Apple EULA prevail for the app obtained from the App Store. Apple is not a party to these terms and is not responsible for maintenance, support or claims relating to the game.

14. Changes

We may change these terms. The current version is published on this page with an updated date; changes that materially affect your rights are announced in the game before they take effect. Continuing to use the game after a change means you accept the updated terms.
